Welcome to BikersBuddy.com and the BikersBuddy mobile application (collectively, "Services"). These Terms and Conditions ("Terms") govern your access to and use of our Services. By accessing or using BikersBuddy, you agree to be bound by these Terms. If you do not agree with any part of these terms, you should discontinue your use of our Services immediately.

These Terms apply to all users of the Services, including but not limited to visitors, registered users, showroom owners, service partners, and contributors.

• Community Features: Reviews, ratings, questions, and social feed
• AI Chatbot: Automated assistance for bike-related queries
• Contributor Program: Rewards for contributing motorcycle information

Intellectual Property

All content on BikersBuddy.com is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or use any of the content without our prior written consent.

User-Generated Content

By posting, uploading, or submitting content on BikersBuddy (including reviews, photos, comments, questions, marketplace listings, and other materials), you:

• Grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your content across our Services and promotional materials
• Represent and warrant that you own or have the necessary rights to the content you post
• Confirm that your content does not violate any third-party rights or applicable laws
• Assume all risks and liability associated with your content
• Agree that we may remove or modify your content at our discretion without notice

We reserve the right to monitor, review, and remove content that violates these Terms or is otherwise objectionable. However, we are not obligated to monitor all user-generated content.

• All transactions are conducted at your own risk
• We do not guarantee the quality, safety, or legality of items listed
• You must comply with all applicable laws regarding the sale of vehicles
• Payment and delivery arrangements are between buyer and seller
• We may remove listings that violate our policies

Bike Assistance Services

Our bike assistance feature connects riders with service partners. You acknowledge that:

• Service partners are independent contractors, not BikersBuddy employees
• We do not guarantee the availability, quality, or timeliness of services
• You are responsible for verifying the credentials of service partners
• Payment terms are agreed upon between you and the service partner
• We are not liable for any damages, injuries, or losses arising from assistance services
• Emergency features are supplementary and should not replace official emergency services (police, ambulance)

Disclaimers and Limitation of Liability

Services Provided "As Is": BikersBuddy Services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

No Guarantee of Accuracy: We do not guarantee the accuracy, completeness, reliability, or timeliness of any information, content, or data on our Services. Motorcycle specifications, prices, and availability are subject to change without notice.

Third-Party Content: We are not responsible for the accuracy or reliability of user-generated content, third-party listings, or external links.

Limitation of Liability: To the maximum extent permitted by law, BikersBuddy, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data
• Loss of use or business interruption
• Personal injury or property damage
• Damages arising from transactions between users
• Damages from unauthorized access to your account
• Damages from errors, viruses, or other harmful components

Our total liability for any claims arising from your use of our Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or BDT 1,000, whichever is greater.

Safety Disclaimer: While we provide safety features like ride tracking and emergency contacts, these are supplementary tools only. Always prioritize your safety, follow traffic laws, and contact official emergency services (police, ambulance) in case of serious emergencies.

Indemnification

You agree to indemnify, defend, and hold harmless BikersBuddy, its affiliates, and their respective officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to:

• Your use or misuse of our Services
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your user-generated content
• Your transactions with other users
• Your use of bike assistance or marketplace services

Termination

We reserve the right to suspend or terminate your account and access to our Services at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended period of inactivity
• Request by law enforcement or government agencies
• Technical or security reasons

You may terminate your account at any time by contacting us or using the account deletion feature in the app. Upon termination, your right to use our Services will immediately cease, but certain provisions of these Terms will survive termination.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.

Before initiating any legal proceedings, you agree to first attempt to resolve disputes through good faith negotiations with us. If a resolution cannot be reached within 30 days, either party may pursue legal remedies.
